Health Data Processing Agreement

I hereby consent to the processing of my health data by Aeon Life GmbH (part of MRI Health Holding AG), c/o Maschinenraum GmbH, Zionskirchstr. 73A, 10119 Berlin, and, for data subjects resident in Switzerland, by the Swiss representative appointed pursuant to Art. 14 revFADP (DataRep / Leutschenbachstrasse 95, Zürich, 8050 Switzerland), in accordance with Art. 6 (1)(a) and 9 (2)(a) GDPR as well as Art. 31 in conjunction with Art. 6 (6)-(7) revFADP, for the purpose of analyzing and enriching my health data within the Aware app in order to provide me with personalized health insights and recommendations.

To achieve this, my health data may be collected through one or more of the following means:

— Blood sample collection by a certified partner located in the European Economic Area or Switzerland for laboratory analysis

— Upload or scan of an existing laboratory report

— Completion of an optional health questionnaire relating to my health status, medical history, and lifestyle

These health data may include sensitive information as defined under Article 9 (1) GDPR and are regarded as “particularly sensitive personal data” within the meaning of Art. 5 (c) revFADP. They will be processed only as necessary for the specified purposes and in line with the data-processing principles of both the GDPR and revFADP; they may be shared with selected partners (e.g., laboratories or technical service providers) solely for data analysis and operational support. Where data are transferred to countries outside the EEA or Switzerland, we will implement an adequate level of protection in accordance with Chapter V GDPR and Art 16 revFADP (e.g., through EU Standard Contractual Clauses or equivalent safeguards).

My health data will only be collected and processed in connection with my active use of the respective app features. This includes, for example, when I submit a lab result, book an appointment, or complete the health questionnaire.

I understand that providing this consent is voluntary, but that without it, Aeon Life GmbH (and its Swiss representative, where applicable) cannot lawfully process my health data and therefore cannot offer its services.

You may withdraw your consent to the processing of your health data at any time with effect for the future. You can withdraw your consent by sending an email to aware@aeon.life. You may also contact our Swiss representative (datarequest@datarep.com) or lodge a complaint with the Federal Data Protection and Information Commissioner (FDPIC), Feldeggweg 1, 3003 Bern, Switzerland, or with your competent EU supervisory authority.

Please note that without your consent, Aeon Life GmbH will no longer be able to provide certain features and services, such as personalized health insights and analytics, or only to a limited extent.
